The decedent was a talented and good-natured 19-year-old who enjoyed an exceptionally close relationship with his mother. Michaels says this case was a peculiar, difficult, and incredibly tragic case. “What made this case uniquely challenging is that the victim was shot accidentally by a childhood friend.”

RESULT: $1 Million Settlement in Shooting Death of Innocent Bystander

The Haggard Law Firm’s Todd Michaels and Michael Haggard have earned a $1 Million policy limit settlement in wrongful death negligent security case of 30-year-old Omarie Stephens was shot and killed at the Lauderhill Mall on Easter Day of 2018.

After spending Easter morning with his family, he went to a car show in a park with his brother and friends. After the show, he went to a restaurant located in Lauderhill Mall to eat. When Omarie and his group arrived at the mall there was a large party going on in the parking lot. The car show had relocated to the mall, which was closed (except for a few tenants including the restaurant).

Video surveillance showed thousands of cars and people in the mall parking lot. Evidence also showed that people were drinking alcohol and doing drugs. The mall’s parking lot had basically turned into an open-air unsupervised night club.

The Mall had retained State Security to provide security. After the mall closed (other than the few late-night tenants) security was supposed to perform constant patrols in the lot and remove trespassers immediately. The evidence clearly showed that over a period of hours, revelers descended on the property, and security was nowhere to be found. They made no attempt to remove people from the property or to contact the police as they were ordered.

In a deposition, the security guard claimed that he encountered a police officer on the property and asked him for help as justification for why he decided not to call police. Police records and the surveillance video disapprove this. After being confronted with the evidence, the security guard admitted he had not come to the front of the mall during the three hour period that people were gathering at the property.

During the gathering, two men got into a fight leading to gunshots. Mr. Stevens, and innocent bystander, was shot and killed. Stephens survived by two minor daughters.

$24.5 Million Verdict in Medical Malpractice/Wrongful Death Case

Ft. Lauderdale, Fla – Following a four-day trial, that included only two hours of deliberation, a Broward County jury has awarded $24.5 million to the family of a mother of four children who died due to avoidable complications during childbirth caused by a condition the medical team was aware of before the surgery.

On July 21, 2015 Lilia Torres arrived at Premiere Perinatal Associates for a scheduled C-section which was delayed until the 22nd. During the procedure, she suffered massive blood loss due to a condition, placenta previa, which had been diagnosed months earlier and was managed throughout the pregnancy. A hysterectomy was performed due to the massive blood loss.

The baby was delivered on July 22, but Lilia went into cardiac and pulmonary shock with severe hypoxia due to the blood loss. She was placed on a vent and began receiving blood cells and plasma. She returned to the operating room for exploratory surgery and passed away on  July 22nd, 2015 resulting from the hemorrhagic shock and multi-organ failure.

 She left behind her husband Rodolfo and four minor children, three girls and one boy. Lilia was the caretaker of her entire family.

Broward County Jury Blames Longtime Las Olas Hotspot for Shooting and Beating of Patron, Orders Business to Pay Victim Nearly $1.2 Million

 

Ft. Lauderdale, FL – Following a 9 day trial, a Broward County jury agreed that management of longtime Las Olas hotspot Mangos could have prevented the beating and shooting of a man if it had adequate security measures in place. The victim (plaintiff) Nicolas Pastor, was awarded $1.182 Million for the injuries he says altered the course of his life.

The incident occurred March 24, 2012.  Pastor was alongside a couple of friends waiting for a table at Mangos in Ft. Lauderdale. The manager of Mangos told the police that night that Pastor was aggressively grabbed by a man inside the restaurant who began viciously beating him along with two other men.

“Mangos had no security and no security procedures to deal with this fight.  According to their manager, their only concern was pushing their customer who had been attacked out into the street with his attackers,”  says Todd Michaels of The Haggard Law Firm.

Michaels tried and built the case with co-counsel Robert Solomon of Saban and Solomon.

Once the fight was in the street, one of the assailants pulled out a pistol and shot Pastor. The then 32-year-old man was rushed to Broward General Hospital where doctors completed emergency lifesaving procedures including an exploratory laparotomy and a thoracotomy. During the trial, Michaels and Solomon made clear that six years later the attack on their client shattered his life-limiting his ability to work, to sleeping, and restricting his ability to play with his son.

Result: $1.5 Million Settlement in Slip and Fall Wrongful Death Case

 

We are very proud to share that our Todd Michaels has secured a $1.5 Million dollar settlement in the slip and fall wrongful death case of Qurris Walker (pictured).

In August 2011, Walker, who suffered from Down’s Syndrome, slipped and fell on a wet floor at the Rosen Shingle Creek Hotel in Orlando. At the time of the incident, the floor was being cleaned by Rosen’s Cleaning service, Majic Cleaning Systems. As a result of the fall, Mr. Walker needed surgery to repair his leg and suffered respiratory arrest during recovery from the surgery. Nearly two years after the fall, Walker, who suffered from numerous pre-existing health issues, passed away. Both liability and causation were highly contested.

The defense argued that Majic had put down five cones in the lobby, adequately warning visitors that the floor was wet and that Mr. Walker’s death was a result of his other health issues, and was unrelated to the fall. Our thanks to the inspirational and brave Walker family for their passion to seek justice.

 

Michaels Delivers Seminar to International Security Organization

The Haggard Law Firm’s Todd Michaels was a featured speaker yesterday at the ASIS International’s 2017 63rd Annual Seminar and Exhibits in Dallas. ASIS is a global community of security practitioners that represent every security-based industry in the public and private sectors.

 

Michaels seminar, “How to Avoid a $100,000,000 Verdict Against Your Business”, was focused on helping security professionals understand how a security plan will not only prevent incidents but also provide a framework for defending a business’s reasonable actions.  Michaels shared his insight on how to avoid a catastrophic lawsuit and used a variety of real-world examples of some of the many notable negligent security case results successfully litigated by The Haggard Law Firm.

Cone Trial Advocacy Institute Includes Michaels as Faculty Member

The Haggard Law Firm‘s Todd Michaels will once again be among the faculty members of this year’s upcoming Al J Cone Trial Advocacy Institute. The Florida Justice Association seminar offers three full days of engaging presentations and interactive workshops designed to advance trial skills. Attendees go through the entire trial process from the defense and plaintiff perspective using a case fact pattern. The event will be held at the Gaylord Palms in Kissimmee Florida from August 3-5.
