On January 31, 2016, Lowe was a guest at the Elysium Hotel in Ft Lauderdale. Elysium was part of a larger group of hotels known as North Beach Hotels. The hotels were comprised of 15 separate hotels over a 1.5-mile square area.

Nearly $1.2 Million Verdict For Man Beat & Shot at Popular Restaurant

Broward County Jury Blames Longtime Las Olas Hotspot for Shooting and Beating of Patron, Orders Business to Pay Victim Nearly $1.2 Million

 

Ft. Lauderdale, FL – Following a 9 day trial, a Broward County jury agreed that management of longtime Las Olas hotspot Mangos could have prevented the beating and shooting of a man if it had adequate security measures in place. The victim (plaintiff) Nicolas Pastor, was awarded $1.182 Million for the injuries he says altered the course of his life.

The incident occurred March 24, 2012.  Pastor was alongside a couple of friends waiting for a table at Mangos in Ft. Lauderdale. The manager of Mangos told the police that night that Pastor was aggressively grabbed by a man inside the restaurant who began viciously beating him along with two other men.

“Mangos had no security and no security procedures to deal with this fight.  According to their manager, their only concern was pushing their customer who had been attacked out into the street with his attackers,”  says Todd Michaels of The Haggard Law Firm.

Michaels tried and built the case with co-counsel Robert Solomon of Saban and Solomon.

Once the fight was in the street, one of the assailants pulled out a pistol and shot Pastor. The then 32-year-old man was rushed to Broward General Hospital where doctors completed emergency lifesaving procedures including an exploratory laparotomy and a thoracotomy. During the trial, Michaels and Solomon made clear that six years later the attack on their client shattered his life-limiting his ability to work, to sleeping, and restricting his ability to play with his son.

$907K Verdict in Waffle House Parking Lot Beating Case

Late Friday, a Ft. Myers jury awarded long haul trucker Steve Long $907, 211 for the injuries he sustained from a 2014 beating by several people in the parking lot of a Waffle House.

The Haggard Law Firm’s Todd Michaels co-counseled the negligent security case along with Dave Mishael of the Law Offices of David B. Mishael and Steven N. Kassner  of Steven N. Kassner, PA.

The team of attorneys explained to the jury that for the 3 years before Long was attacked on April 19, 2014, , there were 24 significant crimes committed on the property. Those crimes included multiple fights (one involving nearly 100 people) and three incidents involving gun shots.

Haggard Law’s Todd Michaels explains “all of the crime and danger occurred in the 3rd shift, nonetheless, there was nothing done about it, IE: no security in the parking lot, no outside security cameras, poor lighting and no manned security.”

Result: $1.5 Million Settlement in Slip and Fall Wrongful Death Case

 

We are very proud to share that our Todd Michaels has secured a $1.5 Million dollar settlement in the slip and fall wrongful death case of Qurris Walker (pictured).

In August 2011, Walker, who suffered from Down’s Syndrome, slipped and fell on a wet floor at the Rosen Shingle Creek Hotel in Orlando. At the time of the incident, the floor was being cleaned by Rosen’s Cleaning service, Majic Cleaning Systems. As a result of the fall, Mr. Walker needed surgery to repair his leg and suffered respiratory arrest during recovery from the surgery. Nearly two years after the fall, Walker, who suffered from numerous pre-existing health issues, passed away. Both liability and causation were highly contested.

The defense argued that Majic had put down five cones in the lobby, adequately warning visitors that the floor was wet and that Mr. Walker’s death was a result of his other health issues, and was unrelated to the fall. Our thanks to the inspirational and brave Walker family for their passion to seek justice.

 

Michaels Delivers Seminar to International Security Organization

The Haggard Law Firm’s Todd Michaels was a featured speaker yesterday at the ASIS International’s 2017 63rd Annual Seminar and Exhibits in Dallas. ASIS is a global community of security practitioners that represent every security-based industry in the public and private sectors.

 

Michaels seminar, “How to Avoid a $100,000,000 Verdict Against Your Business”, was focused on helping security professionals understand how a security plan will not only prevent incidents but also provide a framework for defending a business’s reasonable actions.  Michaels shared his insight on how to avoid a catastrophic lawsuit and used a variety of real-world examples of some of the many notable negligent security case results successfully litigated by The Haggard Law Firm.

Cone Trial Advocacy Institute Includes Michaels as Faculty Member

The Haggard Law Firm‘s Todd Michaels will once again be among the faculty members of this year’s upcoming Al J Cone Trial Advocacy Institute. The Florida Justice Association seminar offers three full days of engaging presentations and interactive workshops designed to advance trial skills. Attendees go through the entire trial process from the defense and plaintiff perspective using a case fact pattern. The event will be held at the Gaylord Palms in Kissimmee Florida from August 3-5.
